These Terms and Conditions ("Terms") govern your use of the website www.thesilenceinstitute.com (the "Website") and your purchase of the digital product "The Silence Switch" (the "Product"). The Website is operated by Andreas Burkhardt, trading as The Silence Institute (the "Seller," "we," "us"). By accessing the Website or purchasing the Product, you agree to be bound by these Terms.
2. Seller and Purchase
The seller of the Product and your contractual partner for all purchases is Andreas Burkhardt, trading as The Silence Institute. The purchase agreement is formed directly between you and the Seller — there is no third-party reseller or Merchant of Record.
The checkout is operated on our behalf using GoHighLevel (HighLevel Inc.), and payments are processed by our payment service provider, Stripe. When you click the "Buy" / "Place My Order" button and complete payment, a binding purchase agreement is formed between you and the Seller. As the Product is a digital item delivered immediately, you expressly consent to immediate delivery upon purchase.
3. 30-Night Money-Back Guarantee
The Product comes with a 30-night money-back guarantee. Because your contract of sale is directly with us, this guarantee is provided and fulfilled directly by us — there is no third party involved.
To be eligible, complete the wind-down ritual for at least seven (7) of the thirty (30) nights and record your readings in the Kettle Journal. If your nights are not calmer, simply contact us at info@mail.thesilenceinstitute.com within 30 days of purchase to request a refund.
Approved refunds are issued directly by us to your original payment method via Stripe. You may keep the Kettle Journal.
4. Strict Medical and Health Disclaimer
The Product is a self-help and educational product. It is not a medical device, medical treatment, or therapy, and it is not a substitute for professional medical care. It is not intended to diagnose, treat, cure, or prevent tinnitus or any other condition. Always consult a qualified healthcare professional before use, especially if you have a pre-existing health condition. 5. Intellectual Property
All content and materials comprising the Product — including audio tracks, text, the Kettle Journal, graphics, and the Website itself — are the intellectual property of Andreas Burkhardt / The Silence Institute and are protected by copyright and other laws. Your purchase grants you a personal, non-transferable, non-exclusive license to use the Product for your own personal use. You may not copy, resell, redistribute, publish, or share the materials, in whole or in part, without our prior written consent.
6. Limitation of Liability
To the fullest extent permitted by applicable law, the Seller shall not be liable for any direct, indirect, incidental, or consequential damages, injuries, or any subjective worsening of symptoms arising from your use of the Product, the Website, or the information provided. Your use of the Product is entirely at your own risk. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, and statutory consumer rights remain unaffected.
7. Governing Law
These Terms and any contractual relationship between you and the Seller are governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer-protection provisions of the country in which you reside.
8. SMS Messaging Program
If you opt in to our SMS program, you consent to receive recurring messages related to your purchase, booking, or support requests. Message and data rates may apply. You can cancel at any time by replying STOP, or reply HELP for help. Your opt-in consent and mobile number will not be shared with any third parties.
